I don't support SOPA. I don't think it will pass. It'll die just like all the previous attempts have died.
As for this petition, though? I would have to do more research into it before believing it would nix all fanart, fanfics, etc.
Fan creations are derivative works and in the case of sites like deviantART and groups like this, no money is being made. Fanworks aren't "piracy" in the way these laws mean. Copyright law is a confusing thing with all sorts of shades of gray, and given the extremely short wording of the petition I believe the writer
might be mistaken.
Using myself as an example, if I draw a picture of Inuyasha in my illustration style (like I always do) that doesn't look like any "official" imagery from Sunrise or VIZ, I own the copyright to
that specific image. I don't own the trademark/copyright to the
character, but I still own the copyright to that specific image because as the artist, I'm the creator of it. If I post something I created online, make note of the fact that "
Inuyasha ©Rumiko Takahashi", and am making no profit from it, there's no copyright infringement OR piracy happening.
As I said, I'll have to look into it more and look at the bill myself before believing what the person is claiming, but I ALWAYS do that no matter who is saying it or what the subject or claim might be. Thank you for the heads up, though.
